| | | | | 代孕合同之法律问题探微 | | | 肖华林 | | | 同其他高科技一样,代孕技术也是一把双刃剑,在造福人类的同时,也带来了一系列法律、伦理等问题。从代孕、代孕合同的概念、特征入手,分析了代孕的几种类型,以及其是否有违民法的一般原理和公序良俗原则,进而阐明了代孕合同的标的,分情况论述了代孕合同所生子女的亲权归属,最后得出应分情况对待代孕合同的结论。

引言2001年2月20日,国家卫生部颁布了《人类辅助生殖技术管理办法》部门规章。其中明确规定:任何医疗机构和医务人员不得实施任何形式的代孕。从中可以看出,我国在代孕这一问题上采取保守的态度。然而在现实生活中,代孕这一行为仍层出不穷。究其原因是卫生部的这一规章容易规避。首先,它只禁止医疗机构及医务人员的代孕行为,对非医务人员、机构无从制止;同时,由于部门规章缺乏域外效力,对本国公民在境外的代孕行为更无法禁止;其次,其法律效力也很低,在现实生活中难以实施。面对以上这些难题,从法律上确定代孕合同的性质及其合法合理性、代孕… | | |  推荐 CAJ下载  PDF下载 | | | CAJViewer7.0阅读器支持所有CNKI文件格式，AdobeReader仅支持PDF格式 | | | | Analysis on the Legal Problems of Pregnancy Contract | | | XIAO Hua-lin (Law Department;Central University for Nationalities;Beijing 100081) | | | Like other high technology,pregnancy technology is a double-edged sword.It can bring mankind benefits,but at the same time it also leads to a series of legal,moral,ethical and other issues.This paper analyses the concept,characteristic and types of pregnancy contracts firstly,and then analyses whether it disobeys the principle of public order and good custom or not.And thirdly,it clarifies the subject of pregnancy contract,describes the parental authority ascription of children born from a pregnancy contract.Finally it comes to the conclusion that we should treat pregnancy contracts respectively.
