| | | | | 企业信息欺诈及其法律防治 | | | 李玉梅 | | | 企业信息欺诈行为已成为我国社会经济发展的严重阻碍力量。本文分析了企业信息欺诈行为的法律特征和企业信息欺诈的法律防治现状,认为强化法律防治刻不容缓,当务之急应做好完善现行企业管理制度,进行反企业信息欺诈专门立法,健全企业信息欺诈刑事惩罚制度等工作。

企业信息欺诈行为是指企业为获取不正当利益,违反诚信原则和信息报告、公开义务,有组织、有计划地向信息使用者报告、公开瑕疵信息的具有广泛社会欺诈性的行为。我国的《公司法》、《会计法》、《统计法》、《产品质量法》等法律共罗列了近40种涉及有关企业信息欺诈的违法行为,刑法设立了虚假注册资本罪、提供虚假财会报告罪、贷款诈骗罪、假冒注册商标专利罪、虚假广告罪等19个罪名,几乎覆盖了企业自设立到终止的全过程,涉及企业活动的基本方面。但法律却未对企业信息欺诈行为有一个明确的说法,形成了实践中对企业信息欺诈行为认识不足… | | |  推荐 CAJ下载  PDF下载 | | | CAJViewer7.0阅读器支持所有CNKI文件格式，AdobeReader仅支持PDF格式 | | | | Enterprise's Information Fraud and the Preventing Measures by Law | | | LI Yu-mei(Law Department;Zhengzhou Institute of Aeronautical Industry Management;Zhengzhou 450005;China) | | | Enterprise's information fraud has already seriously become hindering strength of social economic development of our country.
