| | | | | 民族的文化与现代中国法的精神 | | | 刘焯 | | | 法是一种文化现象,作为整体的民族文化的一部分,它寄身于民族文化之中。一个民族的文化孕育了它的法和法的精神,法和法的精神深深地植根于民族文化。因此法的精神主要应当从其文化中去发现或寻找并获得理解。当代中国正处于由传统向现代的社会转型之中,其文化尚未充分整合并定型,真正现代意义的民族文化也尚未形成。
