| | | | | 产品责任法中“产品”范围的扩大化趋势 | | | 向玉兰 | | | 随着公共政策不断向消费者倾斜,产品责任法中的"产品"范围有进一步扩大的趋势。各国立法和司法或通过修改原有法律,或通过对"产品"概念更宽泛、更灵活的解释,将更多的产品如电、初级农产品、血液智力产品等纳入严格责任管制。作为WTO成员国,我国应该跟上世界产品责任法的发展趋势,完善产品责任立法,将更多产品纳入"产品"范畴。

The legislative and judicial bodies of different countries are bringing more products, like electricity, initial agricultural products, blood and intelligent products, under the ambit of strict product liability, either by amending the existing product liability laws or by applying a broader and more flexible definition of "product". As a WTO member state, China should keep abreast of the world trend towards the development in product liability law, improve the legislation of product liability and bring more products into the scope of "product".
