| | | | | 谈我国农村现代法律秩序的构建 | | | 唐战立 | | | 现代法律秩序必须具有三个特征:有以成文法典、法令、法规或者判例方式存在的法律规则体系;绝大多数人依照法律规则行为;公共执法机构依法维护法律秩序。我国农村法律秩序的现状不容乐观,法律规则体系在农村发生变异,农村行政司法机构维护法律秩序发生了变异,农村风俗习惯和乡村精英个人理念的普遍作用影响着建立农村现代法律秩序的进程。为此,需要完善农村立法,改善农村行政及司法机构执法或司法体制,增强农民法律意识,以构建农村现代法律秩序。
