| | | | | 关于网络中介服务商他人侵权责任的几个问题 | | | 杨仉孙 | | | 网络中介服务商是为实现网络中用户信息的交流而提供中介性服务的单位或个人。他人利用网络中介服务商的中介服务实施侵权行为,中介商是否负侵权责任,这就是网络中介服务商他人侵权责任问题。文章从历史发展、衡平理念角度进行分析,得出其归责理论从严格责任到过错责任的演变;通过分析,归纳了美国DMCA法案的独特所在;并对我国法律应该如何规制网络中介服务商他人侵权提出了个人的观点。

Whether ISPs is responsible for infringement of a third-party through ISPs’ computer system, which is topic of this paper .After analyzing leading cases and legislations of some countries ,especially the USA, it concludes that the criterion of liability is changed from strict liability to negligence liability. The author thinks that this change depends on the equitable protecting theory .The DMCA of the USA is a good example in establishment of criterion of liability in this respect The paper introduces some good experience and legal provision of the DMCA . According to situation in the judicial interpretation of Supreme Court of China, the author gives some constructional legislative opinions in order to promote the development of the Internet’s economy.
