| | | | | 论新闻自由与隐私权的平衡 | | | 储洵 | | | 新闻自由与隐私权都是宪法保护的基本权利,对现代法治社会有着极为重要的意义,但二者的冲突从来没有停止过而且也永远也不可能停止。为了对这两种基本权利进行保护,让他们能够在法律的范围内得到充分的行使,就要在二者之间达致平衡。首要的任务是确定新闻侵犯隐私权的构成要件,其次是为新闻自由设立抗辩事由,包括新闻价值、公众人物、当事人同意、公开场合和使不可辨认。
