| | | | | 论宪法修正案对私有财产权制度的完善 | | | 刘茂林,曾祥明,孙立建 | | | 确认和保障公民私有财产权是宪法的重要内容。2004年的宪法修正案首次明确规定公民的合法私有财产不受侵犯,这是我国市场经济发展、社会结构分化、权利意识增长的结果,也是完善私有财产权制度的客观要求。宪法修正案对私有财产权制度的完善主要表现为明确了公民私有财产权的基本权利性质,提升了私有财产权的法律地位;扩大了私有财产权的范围;完善了公民基本权利的体系和规范结构;进一步完善了宪法上的私有财产权制度。同时,宪法修正案有关私有财产权的规定也为我国私有财产权制度的进一步完善提出了新的要求。
