| | | | | 宪法合法性问题研究 | | | 毛建平,段明学 | | | 宪法合法性是宪法至上权威的前提和基础。不具有合法性的宪法,人们没有义务遵守它,不仅如此,人们还会采取各种暴力或非暴力的方式予以抵制,这样的宪法终究不能长久存在下去。宪法合法性是由人民赋予的,宪法必须体现人民的共同意志和要求,切实以维护人民的权利和自由为己任。唯有如此,宪法才能真正树立起最高权威,发挥其在法治国家中的主导作用。

法治社会是以法律为主治的国家、群体、个体相互之间有条不紊的关系状态。宪法作为最高统治者以其特有的威力控制和支配着整个社会的运转,其他权威必须依附于它,绝对地服膺于它,甚至充当其“蟀女”的角色。但是,当宪法不能充分实现其保障公民权利、限制国家权力、维护社会秩序的神圣职责,抑或其他权威(尤其是个人的权威)不能自主地凌驾于宪法权威之上,社会主体对宪法的顶礼膜拜不再虔诚,社会中时时有人挑战宪法而宪法却不能有效地予以自我防卫之时,宪法的权威无疑受到了严重的侵犯。宪法权威遭受侵犯表明宪法的合法性受到了怀疑或者说宪法合… | | |  推荐 CAJ下载  PDF下载 | | | CAJViewer7.0阅读器支持所有CNKI文件格式，AdobeReader仅支持PDF格式 | | | | An Approach to the Legality of Consitution | | | MAO Jian - ping;DUAN Ming - xue (People's Prosecutors' Office of Beibei District ChongQing;ChongQing 400700;China) | | | The legality of constitution is the presupposition and base of its supreme authority. And only people - confirmed constitution has supreme authority and can play a major role in a state ruled by law.
