| | | | | 关于我国军事司法理论与实践中的几个问题 | | | 张建田 | | | 建国以来 ,我国的军事司法制度经历了一个不断发展和完善的时期 ,国家和军队不仅制定了大量的军事司法方面的法律性文件 ,而且在长期的司法实践中也积累了丰富的经验 ,形成了具有中国特色的军事司法制度。但是 ,毋庸讳言 ,目前我国的军事司法理论及其实践中还存在诸多问题 ,不仅与依法治国方略、依法治军方针的要求存在较大的差距 ,而且也与近年来国家司法改革的趋势极不适应。本文就军事司法的主体、军事司法体制改革、职能作用、法律地位等若干问题进行了探讨。

Not only have we made many military judicial documents, but accumulated a wealth of experience from our judicial practice, which helped to form our military judicial system with Chinese characteristics. However, there are still many aspects in our military judicial theory and practice that are neither in agreement with the policy of rule of law by which we administer our country and our army, nor are they in agreement with the trend of our recent judicial reform. The article discusses issues concerning military judicature in terms of the subject, the system reform, the function and the legal status.
