| | | | | 完善破产犯罪立法刍议 | | | 张奋成 | | | “无罪破产”是人类文明进步的结果 ,但不等于破产过程中不存在犯罪情况。我国当前立法中没有专门的关于破产犯罪的规定 ,致使“假破产、真逃债”大行其道。有必要制定专门的规范破产犯罪的刑事法律 ,对破产欺诈、过怠破产 ,违反破产法规定义务的行为予以惩罚。

So it's essential to institute special criminal laws to restrain bankruptcy,penalizing severely swindle in bankruptcy, neglect of duty in dealing with bankruptycy and activities violating the law of bankruptcy.
