| | | | | 行政法中的比例原则研究 | | | 黄学贤 | | | 比例原则被誉为行政法中的“皇冠原则”。在不少国家中比例原则已得到程度不同的运用 ,并成为这些国家行政法学研究的重要内容。但在我国行政法学中比例原则还鲜有研究。此文揭示了传统行政法中比例原则的涵义 ,并进一步认为 ,传统比例原则仅适用于“干涉行政” ,在现代“给付行政”的条件下 ,比例原则的适用范围应作相应扩大 ,从而使其具有普遍适用性。

It has been applied to a certain extent in Germany, Portugal, Spain, France, England, and Taiwan respectively, and it has become an important part of administrative law research in these countries and the district. However, we haven't paid enough attention to the research into the principle of proportionality. This paper reveals the principle of proportionality in the traditional administrative law and further argues that the traditional principle of proportionality only applies to “interfering administrative law”. Under the condition of modern “giving administrativ law”, the range of the principle of proportionality should be enlarged so that it can apply in every aspect.
